Forms Currently Available for E-Filing and Form-Specific E-Filing Instructions

Note that while many people are eligible to E-File, there are restrictions for some applicants.

 

You cannot E-File if:

·                 You are applying for a waiver of the filing fee; or

·                 You are requesting that your case be expedited (with the exception of Form I-907, Request for Premium Processing).

 

Classification-Specific Eligibility


Each form also has eligibility restrictions for E-Filing. Please see each E-filing Forms Entry Page below for detailed eligibility information.

·                 I-90 – Application to Replace Permanent Residence Card.

·                 I-129 – Petition for a Nonimmigrant Worker

·                        USCIS will no longer accept I-129 petitions for the H-1B category through its E-Filing system. All I-129 petitions for the H-1B non-immigrant classification (both new applications and applications for renewal) must be filed in paper.

·                        Effective May 25, 2005, USCIS will temporarily not accept I-129 petitions for the H-2B category through its E-Filing system. While this category is unavailable through the E-Filing system, all I-129 petitions for the H-2B non-immigrant classification must be filed in paper.

·                        Effective August 30, 2005, USCIS will no longer accept I-129 petitions for the L-1 categories through its E-Filing system. All I-129 petitions for the L-1 non-immigrant classifications must be filed in paper.

 

·                 I-129S – Nonimmigrant Petition Based on Blanket L Petition

·                 I-131 – Application for Travel Document

·                 I-140 – Immigrant Petition for Alien Worker

·                 I-539 – Application to Extend/Change Nonimmigrant Status

·                        Effective April 1, 2006, Form I-539 will be temporarily unavailable to E-Filing system users. If you wish to file Form I-539 with USCIS, you must follow instructions for filing in paper. USCIS will make Form I-539 available to E-Filing system users in the near future. Please check back with USCIS for updated information on the availability of E-Filing Form I-539.

 

·                 I-765 – Application for Employment Authorization

·                 I-821 – Application for Temporary Protected Status

·                        Form I-821 will be available for E-Filing only if a TPS country is designated for re-registration purposes per the Federal Register Notice.

 

·                 I-907 – Request for Premium Processing Service
